Agreement to these terms

Welcome. This website is operated by Kim Fisher, doing business as The Kim Fisher, based in Scottsdale, Arizona ("we," "us," or "our"). By using thekimfisher.com, subscribing to our emails or texts, or purchasing any of our offerings, you agree to these terms. If you do not agree, please do not use the site.

What we offer

The Kim Fisher provides educational content and coaching for midlife wellness: a free newsletter and blog, a daily mantra text program, paid live workshops, coaching programs including The Ageless Reset (a six-week intensive with a full year of ongoing community and coaching support), and a member portal for program participants.

Health and fitness disclaimer

Everything on this website and in our programs is educational. It is not medical advice, and it is not a substitute for the advice of your physician or another qualified health provider.

• Please consult your physician before beginning any exercise or nutrition program, especially if you have a medical condition, an injury, or are pregnant.
• Exercise carries inherent risk. By participating in any movement, exercise, or nutrition guidance we offer, you voluntarily accept that risk and take full responsibility for your own health decisions.
• Stop any exercise immediately if you feel pain, dizziness, or shortness of breath, and seek medical attention.

Kim Fisher is a certified personal trainer and coach, not a physician, dietitian, or therapist. Nothing here creates a medical, clinical, or therapeutic relationship.

Purchases and billing

• All prices are in U.S. dollars. Payments are processed securely by Stripe.
• You agree to provide accurate, current information when you purchase.
• Live workshop registrations include the replay as described on the offer page. Where an offer page says a registration fee credits toward a program, that credit applies as described there.
• We may change prices and offerings at any time. Changes never affect a purchase you have already made.

Refunds

If something isn't right, email kim@thekimfisher.com within 7 days of your purchase and we will work with you personally, whether that means a refund, a transfer to a later date, or a credit toward another offering. Once digital materials, replays, or program access have been delivered, refunds are at our discretion, except where the law requires otherwise. Live workshop fees are non-refundable, yet the replay is yours whether or not you attend.

Your account and the member portal

• Your portal login is for you alone. Please keep it private and do not share it.
• You are responsible for activity that happens under your account.
• Program materials and community access are for enrolled members only.

Community guidelines

Our member community works because it is a kind, private space. By participating you agree to:

• Treat every member with respect. No harassment, shaming, or unkindness.
• Keep what members share inside the community. Never share another member's personal information, photos, or progress outside it.
• No spam, solicitation, or promotion of other businesses.

What you post remains yours, and by posting you give us permission to display it within the community. We may remove content or suspend access for behavior that violates these guidelines.

Intellectual property

All content on this website and in our programs, including workbooks, guides, trackers, videos, mantras, blog posts, and program materials, is owned by Kim Fisher and protected by copyright. You are welcome to use it for your own personal, non-commercial benefit. You may not resell, republish, redistribute, or share program materials, and you may not use our content to create competing products or train automated systems. Sharing a link to a public blog post is always welcome.

Testimonials on this site reflect the real experiences of real clients, shared with permission. Every body and every life is different, and results vary. We make no promise that you will achieve any particular result.

Text message terms

• By opting in to our text program you agree to receive recurring messages. Message frequency varies, and message and data rates may apply.
• Reply STOP to cancel at any time. Reply HELP for help.
• Consent to receive texts is never a condition of any purchase.

Third-party services

Our offerings rely on third-party services such as Stripe for checkout, Zoom for live sessions, and Kit for email. Your use of those services is governed by their own terms and privacy policies. Links to other websites are provided for your benefit, and we are not responsible for their content.

Disclaimer and limitation of liability

The website and our content are provided "as is" without warranties of any kind, express or implied. To the fullest extent permitted by law, Kim Fisher and The Kim Fisher will not be liable for indirect, incidental, or consequential damages arising from your use of the site or our offerings, and our total liability for any claim is limited to the amount you paid us for the offering that gave rise to the claim.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

Governing law and resolving disagreements

These terms are governed by the laws of the State of Arizona. If a disagreement arises, email us first at kim@thekimfisher.com and give us 30 days to make it right. Most things resolve with a conversation. Any dispute that cannot be resolved informally will be handled in the state or federal courts located in Maricopa County, Arizona.

Changes and housekeeping

We may update these terms from time to time, and the current version will always live on this page with its effective date. If any part of these terms is found unenforceable, the rest remains in effect.
